Terms of Sale

1. Ownership of the Software
The licensed software program ("the Software") and any accompanying written materials are owned by Modular Structural Software, Inc. ("the Licensor") and are protected by United States and International copyright laws. By purchasing a license for the use of the Software, the Purchaser does not become the owner of the Software, but does have the right to use the Software in accordance with these terms.

2. Grant of License
The Licensor grants to the Purchaser the right to use the Software as a learning tool or as a design aid to a competent design professional. At any one time, the Software may be installed and used on a single machine, which is designated as Workstation No. 1. A backup copy is permitted if desired. The Purchaser may obtain licenses for additional copies for additional workstations.

3. Restrictions on Use and Transfer
The Purchaser may not copy, distribute, or transfer the Software beyond those locations or workstations granted in this license. The Purchaser may not rent, lease, or lend all or any portion of the software. The Purchaser may not copy or distribute on-line documentation outside of the fair use provisions of the copyright laws without written permission from the Licensor. The Purchaser may not modify, reverse engineer, de-compile, or disassemble the Software. The Purchaser may make a single copy of this program for backup purposes.

4. Disclaimer
The source code for the Software is accessible for examination and/or review by the user. The Licensor makes no warranty, expressed or implied, regarding the accuracy or applicability of the contents of the Software and the accompanying documentation. The user shall make and be completely responsible for the final evaluation of the validity of the results obtained from the use of the Software. Furthermore, such results shall not be substituted for sound engineering judgment.

5. Return Policy
The Software is not returnable with the exception of defective media which will be replaced with a copy of the same module.

6. General
Any action relating to these Terms of Sale shall be commenced and prosecuted in a court located in Broward County, Florida.
